By accessing our Site, creating an account, placing an order, or engaging with our services, you agree to be bound by these Terms, together with our Privacy Policy, Shipping & Return Policy, and Warranty Policy. If you do not agree, please do not use our Site or purchase our products.

  • We reserve the right to refuse service to anyone for any legitimate reason at any time.

  • Product Nature & Diamond Selection: Mirbaha Jewels specializes in certified laboratory-grown diamonds, natural/mined diamonds, and fine precious gemstones. While our online catalog primarily showcases lab-grown diamond jewelry, natural diamonds are available across our collection—whether specified in product titles, descriptions, dropdown selection options, or requested via custom design and bespoke consultations. To ensure complete transparency, each item or certified loose stone is clearly designated as lab-grown or natural in its product specifications, order invoice, and accompanying independent gemological grading report.

  • Approximate Details: All product weights, metal purities, total carat sizes, dimensions, stone color/clarity grading descriptions, and product photography displayed on the Site are approximate and provided for guidance.

  • Natural Variations & Handcrafting: Because each piece is individually set and hand-finished, minor variations in precise stone measurements, subtle color nuances, micro-inclusions, and final precious metal weight are inherent to fine jewelry creation and do not constitute a defect or failure to match description.

  • Grading Reports: Certified loose diamonds and qualifying fine jewelry pieces are accompanied by independent laboratory grading reports (e.g., IGI, GIA, HRD). Lab-grown diamonds typically feature microscopic laser inscriptions on the girdle verifying their grading report number and origin.

4. Intellectual Property Rights

All content, visual interfaces, designs, and materials featured on this Site—including but not limited to the Mirbaha Jewels name, logos, custom jewelry designs, bespoke sketches, product photography, text, graphics, trademarks, trade dress, and software code—are the exclusive intellectual property of Mirbaha Jewels LLC and are protected by United Arab Emirates and international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and view the Site solely for personal, non-commercial shopping and inquiry purposes. You may not copy, reproduce, modify, re-publish, upload, post, transmit, distribute, create derivative works from, or commercially exploit any content, photography, or design elements from this Site without our express prior written consent.

5. Pricing, Currency & Market Fluctuations

  • Currency: Prices are displayed in United Arab Emirates Dirhams (AED) by default, with an optional United States Dollar (USD) conversion display. All final online checkout transactions are processed in AED.

  • Market Rates: Fine jewelry and certified diamond pricing may be adjusted periodically based on global precious metal indices and stone market conditions. We reserve the right to update prices at any time without prior notice.

6. Pricing, Technical Error & Exploitation Protection

In the event that a product is mistakenly listed at an incorrect price, a discount code or offer applies incorrectly due to a system glitch, or an order is placed by exploiting a pricing, technical, or system error:

  • Mirbaha Jewels reserves the explicit right to decline, cancel, or revoke any such order, even if the order has been confirmed, paid for, processed, or dispatched.

  • If an error-affected order is cancelled, we will issue a full refund of the amount paid to the original payment method within [DEFAULT — VERIFY: 7-10 business days].

  • We reserve the right to decline future orders or restrict accounts associated with any customer attempting to exploit system, technical, or pricing errors.

7. Order Fulfillment, Production & Cancellations

  • Individual Production: The majority of our fine jewelry pieces are individually set, sized, or custom-crafted upon order placement. Standard production takes 2 to 3 weeks prior to dispatch.

  • Right to Refuse or Cancel Orders: Mirbaha Jewels reserves the sole right to refuse, limit, or cancel any order at its discretion—including after payment or order confirmation—for reasons including but not limited to stone or material unavailability, unverified shipping addresses, payment authorization failures, suspected fraudulent activity, or breach of these Terms.

  • If an order is cancelled by us after payment has cleared, we will notify you via email or WhatsApp and issue a full refund to your original payment method.

8. Payment Terms

  • Payment must be made in full at checkout via our authorized payment options, including standard credit/debit cards, Shop Pay, or approved wire/bank transfers for bespoke commissions.

  • Orders will not enter production or be dispatched until full payment authorization has successfully cleared.

9. Delivery, Title & Risk of Loss

  • High-value shipments are dispatched via fully insured, signature-required armored or express courier services (e.g., FedEx, DHL, Brink's).

  • Risk of loss and title for purchased items pass to you upon physical delivery by the courier to the delivery address provided at checkout (verified by delivery signature).

  • International orders shipped outside the UAE may be subject to customs duties, import VAT, luxury taxes, or clearance fees levied by the destination country, which remain the sole responsibility of the recipient.

10. Final Sale, Returns & Quality Assurance

  • No Returns for Change of Mind: Because each piece is prepared, set, or sized specifically for your order, all sales are final upon order placement. We do not accept returns, exchanges, or refunds for change of mind.

  • Quality Control & Defect Guarantee: Every item undergoes quality inspection prior to packaging and dispatch.   • Mirbaha Jewels is not responsible or liable for service interruptions, technical glitches, payment processing delays, website downtime, or delivery failures caused by third-party infrastructure providers, payment processors, communication networks (including WhatsApp or telecom carriers), or external logistics operators.

12. Sanctions & Export Control Compliance

  • Mirbaha Jewels LLC operates in strict compliance with United Arab Emirates national laws, executive regulations, and applicable international trade sanctions.

  • We reserve the right to decline, cancel, or refuse service, orders, or consultations to any individual, entity, or destination restricted under applicable UAE law, UAE Central Bank regulations, or international sanction regimes.

13. Force Majeure

Mirbaha Jewels shall not be liable or responsible for any failure, delay, or impediment in performing its obligations under these Terms caused by events or circumstances beyond our reasonable control (“Force Majeure”). Force Majeure events include, but are not limited to:

  • Acts of God, natural disasters, severe weather, or geological events.

  • War, civil unrest, acts of terrorism, military actions, or state emergencies.

  • Government restrictions, trade embargoes, customs holds/delays, or regulatory shutdowns.

  • Global pandemics, epidemics, or public health emergencies.

  • Regional or international internet disruptions, power grid outages, server cyberattacks, telecommunication failures, or logistics strikes.

In the event of a Force Majeure occurrence, our performance timelines shall be extended for the duration of the operational delay.

14. Indemnification

You agree to defend, indemnify, and hold harmless Mirbaha Jewels LLC, its managers, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or legal expenses (including reasonable attorney fees) arising from:

  • Your misuse of or unauthorized activity on the Site.

  • Your infringement of any third-party intellectual property, privacy, or legal right.

15. Limitation of Liability

To the fullest extent permitted by applicable law:

These Terms, together with our Privacy Policy, Shipping & Return Policy, and Warranty Policy, constitute the complete and exclusive legal agreement between you and Mirbaha Jewels LLC regarding your use of the Site and purchase of our products, superseding any prior written or verbal communications, representations, or understandings.

18. Governing Law & Dispute Resolution

  • Governing Law: These Terms and any related agreements shall be governed by and construed in accordance with the laws of the United Arab Emirates, as applied in the Emirate of Dubai.

  • Dispute Resolution: Any dispute or claim arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts of Dubai, UAE.

  • Consumer Protections: Nothing in these Terms shall waive or exclude any mandatory, non-waivable statutory consumer protections provided under the applicable laws of your country of residence.
